Alot of you guys been around a lot longer than me so I'll ask.

I recently bought a portable backhoe from d r equipment.

Cost was approximately $7,000 with accessories.

I shopped around and there were units that were much cheaper, there was a harbor freight backhoe available for literally half the cost.

I didn't want to go that route because I didn't want to buy something that I would have to be messing with to keep working.

I financed the backhoe through a company that Dr suggested. It was all done over the phone and took less than 2 minutes no papers were signed nothing was ever sent to me that I am aware of.

This has all taken place within the past 2 weeks.

I don't and never have bought things on credit I always pay cash for everything but they have a no-interest financing as long as you make the payments over the time. So I decided what the heck.

The Dr portable backhoe has a one year guarantee that if you're unsatisfied with the machine within one year you can return it you only have to pay the shipping charges.

I received the machine and immediately reported minor nitpicking defects  to Dr.

No big deal I thought.

I got the machine out to my property and literally within 3 minutes of the machine running there was a catastrophic failure

The hydraulic pump in the engine became disconnected. The machine was unmovable, nothing worked I had no way to even load it back onto my trailer because the bucket was down on the ground.

I had to do some investigating and research over the weekend myself because Dr customer service and they're techline was closed. I found out that the problem was somebody had either left a set screw loose or didn't install a woodruff key properly, the Lovejoy joint had separated.

Took a couple of hours ane alot of frustration but I got the thing back together and working.

I loaded the tool back onto my trailer drove 230 miles back to my home contacted Dr Sunday evening told them I was done with the machine I want to send it back, my time is valuable I don't have time 2 tote this thing around to have it serviced for problems that should have been addressed before the machine the left the factory.

Yes this is an american-built American manufactured machine, poor quality control.

They have told me to go ahead and send it back if that's what I wish but I will encumber $1,000 shipping charges non-refundable.

I think this is crazy I think that if I would have received a machine in the first place that didn't have so many issues that I wouldn't be sending it back.

What can I do?

I tried researching online consumer protection consumer protection lawyers etc and I'm not having a whole lot of luck.

What can you guys suggest?

No this is not buyer remorse based off deciding I simply had no use, I did not change my mind.

My mind was changed because I assumed I was getting a quality piece of equipment, instead I got something that I could have probably got just as easily purchased at harbor freight.

A starting point is the warranty and return policy. DR is standing by the stated warranty (which you acknowledge) in that they are willing to give your money back less shipping on what is now a working unit. While it sounds like a mistake was made during the build of your unit, DR has been around for a long time and I believe they are considered pretty reputable - now that it's fixed you might not have any other issues.
 
YOu said it was within a few days that you called them to send it back.

FIrst: The consumer protection act in each state varies from state to state and THUS I can not tell you what the act says in your state..

Generically you should have 3 business days to change your mind. HOWEVER I do not know if that is from time of agreement or delivery.

You need to find an attorney who specialises in Consumer Protection or the Uniform Commercial Code.

THat said. now that you have fixed the error.. IT might last for years.  I do not know and am unable to discuss. YOu worked on it so I am assumig you now how well. or bad it was built.

IMO...at this point...... just fix it,  and go on with life. 

(it's really not worth all the stress on your heart)  :))
 
If you feel the backhoe will do the job I would keep it and get back to work.

The shipping cost to return it is a little high, But they have to charge for the shipping in order to stop people from buying and returning after the job is done.

Just a heads up..I've owned 2 backhoes and they are high maintenance. If taken care of they will last for years.

It's just tough to buy a product, pay alot more than I had too and yet still have a failure right out of the gate
 
Use it for the majority of the one year return caveat. If you have multiple problems send it back. You will have had a years use out of the machine for $1,000. As it is now you have no use.
 
Not sure how you paid for it. In the UK if you pay for something by credit card and have major issues the credit card company will get involved and act on your behalf. This may be different in the US and consumer rules will be different too.  Thought I'd mention it just in case.

Most if not all credit cards offer the same service. However 1930 financed though a 3rd party @ 0%. Not a bad deal.

If the backhoe will now do the job I say put it to work.. If another problem pops up then pay the return shipping and move on.
 
I agree with several of the other commenters here. Use the equipment for awhile, at least through the summer, and if it is still giving you trouble, send it back and you will have had the use of it for the time you've had it. I have DR equipment now and love it. Hopefully you will too after you use the equipment for a while.

Maybe it would be good for pulling really small stumps out of Sandy soil.  Maybe.

You probably did not pay too much .....never compare any good tool to a Harbor Freight tool.

A Harbor Freight wrench will bend if you drop it... ;D

Just to update, DR took the machine back all on their own tab.

All I had to do was pick up the phone ( versus sending email) explain the situation. Good company and they did the right thing

Good to know...I haven't used any DR toys but I would feel better about buying something knowing they stand behind the product.

I am in the market for a small loader/backhoe similar to this https://www.ebay.com/itm/ditch-witch-1025sk-front-end-loader-backhoe/382716291298 but Id prefer a  closer product so I can examine personally.

If anyone has any suggestions of a commercial grade unit  that I can fit into my high cube storage container Id sure like to hear of it.
